The National Highway Traffic Safety Administration said Friday it has opened a formal audit into nearly 1,000 Tesla Cybercab vehicles, examining the process and technical data the automaker used to certify the driverless two-seater as compliant with federal vehicle safety standards. The audit follows Tesla’s Thursday launch of limited commercial Cybercab service in Austin, Texas, with the company saying it plans to gradually add vehicles and expand to new locations. Tesla had 420 autonomous vehicles registered in Texas as of Friday morning, according to state records, including 45 Cybercabs.

Audit Targets Certification Process

NHTSA said it will examine the basis for Tesla’s certification of the Cybercab, including how the company determined that certain Federal Motor Vehicle Safety Standards did not apply to a vehicle built with no human controls. Automakers typically self-certify compliance with those standards — the same process used for every Toyota Camry or Ford F-150 sold in the U.S. — rather than seeking pre-approval from the agency. NHTSA said the Cybercab lacks permanently attached conventional manual controls, including a steering wheel, brake pedal, accelerator pedal and mirrors — features federal rules have traditionally assumed every vehicle would carry. The agency already has several open investigations tied to Tesla’s driver-assistance and autonomous systems, including a probe examining whether the company’s camera-only sensors adequately detect reduced-visibility conditions such as fog, glare and dust, a review that covers multiple documented crashes and at least one fatal pedestrian collision. The scale of the new audit, covering roughly 1,000 vehicles, is notably larger than Tesla’s current deployment:

  • The review covers Cybercab units already produced, not only those operating on public roads today
  • NHTSA has not said whether the audit could lead to a recall, a fine, or a formal demand that Tesla seek a safety-standard exemption

Fleet Still Small But Growing

Tesla’s Texas footprint remains modest next to its ambitions. State records showed 420 autonomous vehicles registered as of Friday morning, including 45 Cybercabs, compared with roughly 988 vehicles registered in the state by Alphabet‘s Waymo, the current U.S. leader in driverless taxis. Tesla has said it plans to widen Cybercab service to more vehicles and additional cities as production ramps at its Texas factory, after CEO Elon Musk cautioned earlier this year that initial output would be slow.
